Only the promoter, or ticket platforms authorised by the promoter are allowed to sell or resell event tickets. Unauthorised resale is a criminal offence and can attract a €15,000 fine, which rises to €30,000 if the offence is repeated.

However, if you include a clause in the ticket’s terms and conditions (known in Germany as AGBs) prohibiting resale above 25% of its face-value, resellers must not offer the ticket above this price. For this clause to be valid, tickets must be personalised. Personalised tickets are defined as those with a box on the ticket for the buyer’s name.
By accepting the terms and conditions of the ticket portals, ticket buyers confirm they understand that any resale is invalid if they resell the tickets for more than a surcharge of 25% on the original price.
This clause was developed by German trade group BDKV, and has had two successful rulings in its favour (one in the Hanover Regional Court, and again on appeal in a leading German civil court).

Ticket terms and conditions can ban resale through unauthorised platforms, this enables promoters to delist tickets being sold on such platforms, including by business sellers. Ticket resellers must also be transparent about: the details of the original ticket including any restrictions on its use, and if the seller has any connection with either the site on which they are selling, or the organiser of the event for which the ticket is being sold. The platform must also indicate if the seller is a business seller and, if so, provide the business seller’s postal address.
